ACCEPTANCE OF TERMS

BY ACCESSING, BROWSING, OR USING THE SIMPSONIZEME.CO WEBSITE (“WEBSITE”) OR ANY OF OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE (“TERMS”) AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE OUR WEBSITE OR SERVICES.

These Terms constitute a legally binding agreement between you (“User,” “Customer,” “you,” or “your”) and SimpsonizeMe.co (“Company,” “we,” “us,” or “our”).

1. SERVICE DESCRIPTION

1.1 Digital Portrait Services

SimpsonizeMe.co provides AI-powered digital portrait transformation services that convert user-submitted photographs into Simpsonized artwork (“Services”). Our current offerings include digital products delivered electronically.

1.2 Future Physical Products

We reserve the right to offer physical merchandise and customized products in the future. All such products will be fully customized and made-to-order based on your specifications.

1.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice. We may also impose limitations on certain features or restrict access to parts or all of the Services without notice or liability.

2. ELIGIBILITY AND ACCOUNT REQUIREMENTS

2.1 Age Requirements

You must be at least 18 years old to use our Services. If you are between 13-17 years old, you may only use our Services with explicit parental or guardian consent and supervision.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information when creating an account and to update such information as necessary to maintain its accuracy.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. PAYMENT TERMS AND PRICING

3.1 Payment Processing

All payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe’s Terms of Service and Privacy Policy. We do not store or process payment card information directly.

3.2 Pricing and Fees

  • All prices are listed in USD and are subject to change without notice
  • Prices include all applicable taxes and fees unless otherwise specified
  • Payment is due in full at the time of order placement
  • We reserve the right to modify prices at any time

3.3 Payment Authorization

By providing payment information, you authorize us to charge the specified amount for your order. You represent and warrant that you have the legal right to use the payment method provided.

3.4 Failed Payments

If payment fails or is declined, we reserve the right to cancel your order without liability. You remain responsible for any fees or charges incurred.

4. NO REFUNDS POLICY

4.1 Digital Products

ALL DIGITAL PORTRAIT SERVICES ARE FINAL SALE. WE DO NOT OFFER REFUNDS, RETURNS, OR EXCHANGES FOR DIGITAL PRODUCTS UNDER ANY CIRCUMSTANCES. This includes, but is not limited to:

  • Completed digital portraits
  • Partially completed orders
  • Orders you are dissatisfied with
  • Orders containing technical issues on your end
  • Orders where you change your mind
  • Orders where you uploaded incorrect or poor-quality source images

4.2 Physical Products

ALL PHYSICAL PRODUCTS ARE COMPLETELY CUSTOMIZED AND MADE-TO-ORDER. NO REFUNDS, RETURNS, OR EXCHANGES WILL BE ACCEPTED FOR PHYSICAL PRODUCTS UNDER ANY CIRCUMSTANCES due to their custom nature.

4.3 Free Revision Policy

In lieu of refunds, we offer FREE REVISIONS per order for digital portraits if you are not satisfied with the initial result. Revision requests must be submitted within 7 days of delivery and must include specific, actionable feedback.

4.4 Revision Limitations

  • Revisions are limited to adjustments to the existing portrait
  • Revisions do not include changing the source photograph
  • Revisions do not include fundamental style changes
  • Additional revisions beyond the first are available for an additional fee
  • We reserve the right to determine if revision requests are reasonable

4.5 Chargeback Policy

INITIATING A CHARGEBACK OR PAYMENT DISPUTE AFTER RECEIVING YOUR ORDER CONSTITUTES FRAUD. We will pursue all legal remedies available, including but not limited to:

  • Providing evidence of service delivery to payment processors
  • Pursuing legal action for fraudulent chargebacks
  • Reporting fraudulent activity to relevant authorities
  • Seeking damages and legal fees

5. INTELLECTUAL PROPERTY AND USAGE RIGHTS

5.1 Your Source Images

  • You retain ownership of the original photographs you upload
  • You grant us a limited license to use your images solely for creating your portrait
  • You represent and warrant that you own or have the right to use all uploaded images
  • You are prohibited from uploading images of others without their explicit consent

5.2 AI-Generated Portraits

  • We retain ownership of the AI technology and algorithms used to create portraits
  • You receive a non-exclusive, non-transferable license to use your completed portrait for personal purposes
  • Commercial use of portraits shall be completely your responsibility
  • You may not reverse-engineer or attempt to replicate our AI technology

5.3 The Simpsons Trademark

  • “The Simpsons” is a trademark of Twentieth Century Fox
  • Our service creates parody and transformative art protected under fair use
  • You acknowledge that portraits are derivative works in the style of The Simpsons
  • We do not claim ownership of The Simpsons characters or trademarks

5.4 Prohibited Uses

You may not:

  • Resell or redistribute your portraits without permission
  • Use portraits for commercial purposes without written consent
  • Claim ownership of our AI technology or processes
  • Create competing services using our portraits or technology

6. USER RESPONSIBILITIES AND PROHIBITED CONDUCT

6.1 Image Upload Requirements

You agree to only upload images that:

  • You own or have permission to use
  • Are of sufficient quality for processing
  • Do not contain inappropriate, illegal, or offensive content
  • Do not violate any third-party rights
  • Are suitable for transformation into cartoon-style artwork

6.2 Prohibited Content

You may not upload images containing:

  • Nudity or sexually explicit content
  • Violence, hate speech, or discriminatory content
  • Copyrighted material without permission
  • Images of minors without parental consent
  • Illegal or harmful content
  • Content that violates any applicable laws

6.3 Account Misuse

You agree not to:

  • Share account credentials with others
  • Use automated systems to access our Services
  • Attempt to reverse-engineer our technology
  • Interfere with or disrupt our Services
  • Upload malicious code or viruses
  • Engage in fraudulent activity

6.4 Violation Consequences

Violation of these Terms may result in:

  • Immediate account termination
  • Forfeiture of all payments
  • Legal action
  • Reporting to law enforcement

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICES
  • DAMAGES FOR ANY OTHER MATTER RELATING TO THE SERVICES**

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

7.3 AI TECHNOLOGY LIMITATIONS

You acknowledge and agree that:

  • AI-generated results may vary and are not guaranteed to meet expectations
  • Portrait quality depends on source image quality and suitability
  • Results are subjective and based on algorithmic interpretation
  • We make no guarantees about accuracy, likeness, or satisfaction
  • Technical limitations may affect final results

7.4 THIRD-PARTY SERVICES

We are not responsible for:

  • Stripe payment processing issues
  • Internet connectivity problems
  • Email delivery failures
  • Third-party service interruptions
  • External website or service functionality

7.5 FORCE MAJEURE

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or technical failures.

8. INDEMNIFICATION

  • YOUR UPLOADED CONTENT OR IMAGES
  • ANY FRAUDULENT OR ILLEGAL ACTIVITY**

9. PRIVACY AND DATA PROTECTION
